[Solved] My 19 year old daughter has a baby

My step daughter is 19, and has had a baby, do i still have to help my husband pay for child support? She was studying to be a nursery nurse, not sure what has happened to that now she has a baby

Hi

Is this paid through the CSA and if so, when was the case opened? If it was after 2003, then your income isn't taken into account at all anyway - prior to that I'm not sure about the rules. That aside, I'm not sure whether there is continued liability once your step daughter is claiming benefits (ie child benefit) so it might be worth having a word with the CMS anyway.

We have been paying for her since 2002. We never see her as she lives too far away. So no contact to let us know if she is still in education despite having a baby of her own. How would we go about asking the CSA if she still needs this weekly payment?

I'd give the CSA a call to clarify the rules if she is claiming child benefit (which I'm sure she will be).

As pointed out by actd, your income would only be taken into account if a case was opened with the Child Support Agency (CSA) before 2003.

The rules now state that maintenance should continue until a child is 20, if still in full-time, non-advanced education. Maintenance can also stop in other circumstances, such as if the child starts receiving certain benefits in their own right.

It does largely depend on what type of arrangement you have and who it is arranged through. If you do have a case with the CSA you can contact them directly for full clarification. You can find their contact details here https://www2.dwp.gov.uk/csa/v2/en/contact/index.asp, or on any correspondence you have received from them.
