Hi All,
I am new here, but desperately seeking advice it starts with my sons mother . . . . .
My son has left full time education last sept 09/14 however I have still been paying maintenance since then and up to date, my son has now left home and is back in contact with me and he has made me aware of the fact that he has been working and not in full time education.
However I reported this to Cms only to be told they have made contact with his mother and she has denied that he has not been in education she is stating he has been in education all along. And as I have no proof they can not pursue this matter any further due to an additional fact that she is still in receipt of child benefit so this is proof for them he is still classed as a child?????
Is this for real?
could anybody please advise what my next steps should be??

She is fraudulently claiming and you can report her to the Child Benefit Office, but it is so unfair that the onus is always on the paying parent to prove these things and everything that the resident parent says (usually the mother) is taken as gospel.
If you don't get any joy you can go and speak to your MP , or ask your son to write a letter confirming he is working and when he left full time education and see whether this will satisfy the CMS.
Thank you for your reply, I have suggested a signed letter with all the facts from my son made out to the CMS however they have stated this is not sufficient as evidence in the case, also I have been told I am unable to appeal this decision and that is final.
My son left his mothers home in December however his mother has stated he did not leave home until january 7th coincidentally the day before the CMS actually made contact with her, so now I am being punished further by having to make another final payment to cover dec - january maintenance to satisfy the CMS, how can they really legally extract this additional fraudulent payment from me??
Surely they are an accessory to benefit fraud by doing this???
I am in pure disbelief with the whole process from start to finish, they are so incompetent and disorganised even down to the monthly payment they deduct from my salary which is always incorrect, every month they have taken too much from my salary and then make me wait 3weeks for a refund and try to blame the reason on my companies payroll department.
this whole service is morally wrong I was literally made homeless at one point last year by fault of the CMS for extracting too much money from my salary on 2 consecutive months which left me in a position where I could not pay my rent let alone anything else.
They have had a seriously adverse affect on my life throughout the period I have had to deal with them adnd i just feel helpless against them!!
