[Solved] me and my new spouse have a joint bank account

hi,

My ex wife has asked me to pay more maintenance for my son (as punishment for me wanting increased access!!). Me and my new spouse have a joint bank account so will our combined income mean we have to pay more?

Any info will be much appreciated

No, only your income is taken into account.

Child maintenance and contact are not linked in law and issues with one should not affect the other. Child maintenance is calculated by using the paying parent's gross income, which is income before Income Tax and National Insurance are taken off, but after occupational or personal pension scheme contributions are taken away. In most cases this gross income figure comes from information given to HM Revenue & Customs (HMRC) by the paying parent, their employer or a third-party such as an accountant.

If you have a family-based arrangement in place, you may wish to discuss and negotiate your maintenance payments with the other parent. Although, family-based arrangements are not legally enforceable, parents can decide the terms of their agreement to suit their current circumstances, as there are no strict rules or formulas to follow.

If you have a case with the Government’s statutory scheme you may wish to contact them directly to discuss your concerns regarding your payments. You will find their details on any letters they have sent you or on Gov.uk at https://www.gov.uk/child-maintenance.

If you have a Consent Order/Minute of Agreement in place you may want to see what is stipulated within your agreement regarding your payments. Alternatively, you may want to seek legal advice.
