[Solved] Maternity Allowance & CSA

Long story short if you haven't seen my previous post. My partner is £2,500 arrears with a woman claiming her 1yr old son is his.

They're claiming that they are about to start taking just under £400 from his wages a month yet haven't taken into consideration our new born baby or my partners other son who we have every other weekend.

I have just found this online and begs the question would this count in our case? I'm about to start receiving maternity allowance does this mean we would be on the flat rate?

Hi Hannahf_

It has to be the "paying parent" themselves that receive "maternity allowance", rather than their partner. The list in your image is split into two. The first applies to either the paying parent (your partner in this case) and you (as his partner whom he lives with), while the second list applies only to the paying parent (your partner). I do agree though that it is not wholly clear.

You can use this (from your partners perspective, as the paying parent).

Thank you, massive sigh there but it is what it is - seems ridiculous that it works the other way round just not for us. The CSA don't care about the child at all - they care about making a case and causing misery otherwise they would have understanding for children on both ends.

I've looked at that calculator and it tells me we are the basic rate so I really cannot see where they get £362 from?

I would imagine that as there are arrears they are adding those into what they are taking, once the arrears are paid off it should drop to a more managable amount.
