Hi Sammy33

Thank you for your post. I am William, the Child Maintenance Options consultant. We are unable to comment on Child Support Agency (CSA) case-specific enquiries as we are a separate organisation to the CSA and do not have access to your case information. However, I can provide you with some general information.

When working out child maintenance, the CSA may also take in to account any Child/Working Tax Credits that the paying parent, or their partner or spouse, may receive. This is because it is classed as a household income. The only time Working Tax Credits would not be taken into account is if the paying parent’s spouse or partner is the main earner in the household. However, Child Tax Credits are always taken into account. Under the current statutory rules which are used by the Child Maintenance Service, Child and Working Tax Credits are not included in child maintenance calculation. You can find more information on how child maintenance is worked out on Gov.uk at https://www.gov.uk/how-child-maintenance-is-worked-out.

You may wish to contact the CSA directly for further guidance. You can find the contact details for the CSA office that is dealing with your case on any letters they have sent you, or via Gov.uk at https://www.gov.uk/child-support-agency.

For more information on the ways to set up child maintenance, please visit our website at http://www.cmoptions.org. Alternatively, you can call us free on 0800 988 0988 between 8am and 8pm Monday to Friday or 9am and 4pm on a Saturday. We have a sorting out separation web-app that you may find useful. It offers help and support to separating and separated families. The link is: www.dad.info/divorce-and-separation/sorting-out-separation.

Regards

William
