Can anyone tell me if the CSA takes your working tax credits into account when they sum up your income for maintenance ??
Not if your on the new 2012 CMS
If your on the 2003 system then yes but of you let me know which system your likely to be on, I can explain more about that
Hi Huxley, I'm sure she contacted the CSA in August 2013, so does this mean my working tax credits will be counted along with my wages when the CSA sums it all up ?
Huxley I forgot to say the CSA was taking money off my benefits for a number of years before I started working last July. I heard nothing from them during the 7 months I have been working. During this time I paid my ex partner faithfully for 7 months never missing a payment and yet she managed to involve the CSA so I'm now not sure if this is a new case or an old one. I'm so confused about the whole thing.

If she applied to the CSA in August 2013 it would be on the 2003 system, what I call CSA2
Now you don't have to tell them you get tax credits (unless the maintenance enquiry form asks) I can't remember as my last assessment was done over the phone and I wasn't asked about tax credits, I was just asked how much my wage was per month, how much my pension was and how many overnight stays did my children have with me.
So if you are the higher earner, then yes they would be included (if they ask)
WORKING TAX CREDITS;
Are deemed the income of the higher earner. If earnings are equal, they are split 50/50.
CHILD TAX CREDITS;
Are deemed the income of the NRP.
I do hope you have some proof you've paid the ex since August? Because if the ex has called the CSA up last August then it could be backdated but you say you've heard nothing from them?
Did you tell the CSA you were no longer on benefits in July?
The CSA knew my benefits stopped in July 2013
December 2013 was the first time CSA made me aware there was a problem.
I’ve had different figures from different CSA workers since then.
I have bank statements to prove that I paid her £100.00 a month maintenance from August onwards. with no missed payments, but CSA wants me to pay her £38.00 a month, thus resulting in £72.00 a month arrears they say I am due. I can’t possibly be due her these arrears.
I also have 2012 bank statement proof I paid her the extra £40.00 pounds at a time while the CSA was paying her off my benefits.
She didn’t declare this extra maintenance to the CSA but I can prove she did receive it.
She held my son back from me for 7 months so I had no option but to pay her this extra money off my benefits. I finally had to go to my lawyer.
I started working in July 2013 and I am on the basic wage.
My calculations through the CSA calculator states she is entitled to £84.00 a month, not the £100.00 a month I am paying her.
I have also took into account my sons 4 nights a month staying over with me.
It also costs me £20.00 a month in petrol to travel back and forth to pick up and drop off my son. This money was never included in my calculations.
On checking my payslip I notice CSA must have tried to collect money but my payslip says CSA £00.00

Also I am paying full rent and Council tax and I have not yet applied for working tax credits. I'm now wondering if the CSA would count this along side my wages and would my ex partner get the benefit of that also.

Yes the CSA would include working tax credits along side your wages, but like I mentioned above they don't always ask if you receive it
They really should be asking if you paid direct from August, have they actually said they are not taking into consideration you have paid direct, even though you have proof?
I only came across the proof yesterday once I worked out how to get into historic banking. I have had to order a new printer so I will be sending off copy's of the proof shortly to the CSA
I was reading somewhere that the receiving parent should notify the CSA of any changes. The fact she didn't report this extra maintenance including the money CSA was giving her off my benefits at the time in 2012, do you know if it will make a difference when it comes to the CSA looking for arrears of me?. The CSA know I have been paying her since August 2013 as they were able to send me a run down of my payments from August up to January.

Yes any changes should be notified and because this has now given you arrears because she did not notify you we're paying direct is not right, send the copies off to the CSA and go from there, if you have no joy, then you need to write to the complaints resolution manager at the address in which your case is held and go from there
Hi Huxley, I don't know how you've managed to keep up with me. After reading back all my posts I can see how I am confused. It's only when I put it in writing I can see how muddled up I am. I want to thank you for your help and I will keep you posted on the outcome of all this. Keeping fingers crossed it all works out well. If not I will go to the complaints and hope they can fix this all out...
