If you are paying full maintenance (due to ex not allowing the children stay with me), when it comes to summer holidays, am I obliged or legally meant to take time off to share the holidays? (Can I add it’s not that I am not wanting to spend time with them but my ex is stating it is my (legal) obligation. TIA

hi,

do you have a court order in place for child arrangements? generally these are based on rules that resident parent must make children available to non resident parent. it's down to your availability. some dads miss occasions due to work or other commitments, and they are not breaking court orders if this happens. with CMS, their position is that it's a legal obligation to pay maintenance whether you see children or not.
