I’ll give a brief overview.
- I have 2 children with 2 different mothers. 1 is a family based arrangement and one is a CMS case.
- I am in receipt of benefits recently
- CMS have assessed my case with them as £7 per week, but they will not reduce this further due to the other family based arrangement. I’ve said it should be £3.50 as the £7 is split between all children.
- they have said as the other case is a family based arrangement, they cannot reduce the £7 down any further on the case with them. They have checked records to confirm that he other child does exist.
Is this correct? Seems unfair to me, seems like I am being punished for making a family based arrangement and they have said the only way they can reduce further is to get the second parent to open up a case with them at a Cost of £20
Unfortunately, I believe they are correct in this. You are able to open the case yourself, it doesn't have to be your ex who does this, but it will still cost £20 to do so. You would need to speak to your ex beforehand just so their is no misunderstanding why you are doing this.
