[Solved] Maintenance and attending college (PROOF) scotland

Hi everyone on here.

I have been guided to this site to ask for some info on my situation like many people on here I’m looking for advice on a certain matter.

So my situation is I’m having to pay child maintenance for my daughter who is 17 and atending college I don’t have any contact with my daughter or her mothers family. I’m looking to see how I can find out if my daughter is attending college as her last 2 years of school she did not attend school and I was unaware of this and continued to make payments and they were paid each month then at the start of August 17 my daughters family told my parent that she would be attending college and payments would need to be made until child is 20.

During the summer months I know from my mother that my ex was not receiving child benefit or child tax credits and and this is why they have managed to get my daughter to agree to go to college so that they do not lose out on child benefit and tax credit. So all I have asked is that they provide me proof that my daughters actually attending college each day like she is supposed to and I will keep paying the maintenance money they have refused and say d they don’t need to provide me with anything. As I said above my daughter and her family told lies and didn’t tell anyone that she hadn’t been attending school for 2 years so I find it really hard to believe she is at college every day. Is there some way I can find out if she isn’t attending would benefits stopp if she wasn’t attending college I know nothing about this stuff I just want to find out the truth I’ve had to go to my local mp in the past because they have made fraudulent claims in the past and my mp sorted it out so I’m no wanting them to play me for a fool a second time round. Any help would be appreciated thanks I’m also based in scotland

Child maintenance is only dependant on being in full time non advanced education after the age of 16.

So only after her 16th better does what education she is doing matter.

I would verify exactly what it is you want to know - and the value of it.

I am not 100% sure but I imagine that "attending college" everyday ( or not ) is NOT the thing CMS would look at it - I would imagine it is if she has a valid enrolment. ( e.g. I think it would down to the school/college to manage attendance - but a child not in daily attendance would I imagine still be enrolled up till the point the school/college kicks the child out - when you consider a child going on some days, or some of the time each day then it would be a big grey area).

Even if you prove that she is NOT attending college every day or much - it might not matter to CMS if she is enrolled - so you might put a lot of effort in to prove something that can't change anything.

I think it would be a different matter if she was not attending AND working as far as the benefits departments and HMRC are concerned.

Hi I wanted to post an update to my case to see if I can get further info on dealing with this.

So my daughter enrolled for college and started in August 2017 and attended for one month and stopped attending at the end of September 2017 I paid maintantance for her every month between the months August 2017 and December 2017 then stopped payments for January.

I have no had a letter from csm demanding I pay £35 a week standing order to them and say I’m £356 in arrears for jan18 to March 18.

I do not understand this as my daughter can’t be considered to be in full time education having only attended 1 month. I have written to my mp and he has written to cms and I’m awaiting a reply.

Will the cms be able to contact my daughters college to confirm that she only attended for 1 month ?

Unfortunately, it's unlikely that they will - it's more likely that you r ex is still claiming child benefit, as the CMS base it on that fact.
