my eldest daughter is off to uni she is 18 yrs old , i have been paying maintenance for my 2 children now my ex is saying that i have to pay for my 18yr old daughters uni living exspences and then pay 10% of my gross wage to her for my youngest daughter ? is this corerct and can just carry on paying what i was before for the 2 and use half of that for my eldest daughter ?
also why is it 10% of my gross pay and not NET as im sure its not tax excempt ?

Under current legislation, child maintenance payments should continue until a child is 16 or until they are 20, if they are in full-time, non-advanced education. If your daughter is at university, that would mean she is in advanced education, therefore you would have no legal responsibility to pay.
The amount you pay would reduce of course now that you are only paying for one child. There is a calculator on the Child Maintenance Options website, http://www.cmoptions.org, which will provide an estimate of the amount that the Government would consider reasonable for you to pay. The Child Maintenance Service, who are now the Government’s statutory maintenance service, use the paying parent’s gross pay rather than net as the Child Support Agency (CSA) used to do.

Hi There,
As said above, you will no longer have liability for your daughter who is off to Uni, and the amount you pay will drop, I would as suggested take a look at the CMS website and look for the calculator, that will give you an idea of what you should pay to your ex.

thanx for advice .............how is it that CSA use Net Pay and the CMS use gross pay ? maintenance payments arnt tax excempt so once i pay tax on my salary then surley paying 10% gross i will be paying more than i should so would it not be 10% of my net that i actually pay ?

That was a change that was made in the switch from CSA to CMS, but at the same time, they also reduced the percentages that were used for the calculation. As a result, on simple PAYE salaries at less than around £25k, if I recall, there isn't a great deal of difference in the monthly payment between CSA and CMS methods of calculation, and on salaries below the personal allowance, where no tax is paid, CMS means that the amount is lower.
