[Solved] Maintenance

Hi
I would like some advice please if possible about when to stop paying child maintenance.
My daughter is 18 soon to be 19 in August she is now pregnant lives at home with her mother and stepfather and does not go to college anymore but claims jobseekers..
I just needed to know if it's ok to stop now, I've had an agreement with the mother from where I've been paying into her account each month.
She is not really a reasonable person to talk too so would like some advice on weather it's ok to stop and I can arrange to put monies into my daughter's when needed.

Hi there

If she is out of education then I think it only fair that you stop paying, although I'm sure your daughter would appreciate some help from you, with a baby on the way.

As you appear to have a family arrangement, as opposed to paying through the CSA, I would write a letter of intent to the mother and give her a month or so notice of your decision, just to give her time to make any adjustments.

If your daughter is not in full time education (you do not have to pay if at university) or Child Benefits have ceased in regards to her, you do not have to pay a penny. It is up to you if you wish to help her out financially but you are not obligated to do that.

I agree with the above, if you write and inform your ex that you plan to stop paying then there isn't too much that she can do, she would only have the option of applying to CMS to start a case, but by the sounds of things she wouldn't be entitled to anything as of your daughters age and not being in education any more.

As a general rule, child maintenance is expected to be paid while ever a child is eligible for Child Benefit. If you are unsure whether or not Child Benefit is still being paid, under current child support legislation child maintenance is usually paid until a child reaches 16 years old, or until they reach 20 years old if they are in full-time (an average of 12 hours or more per week), non-advanced (up to and including A-level equivalent) education. Therefore, based on what you have written, it sounds as though your daughter is no longer eligible for child maintenance.
