Hi looking some advice.
I have 2 children to same mum and she opened a claim with CSA in June 2017 since Aug I have been paying £380 on the 1st of every month. I was't able to make 1st of April's payment due to legal exepenses with ongoing discipline case with my job. I told mother of kids I would make the payment up on 1st May 2018 she contacted CSA and let them know amd I have heard nothing from them. I was dismissed from work this week and my employmemt ends on 13th May 2018 I had a government based job and am due to get paid on 1st May 2018 full month and 1st June 13 days pay plus holiday pay I couldn't use due to being suspended from work. My ex knows I have lost my job and is enquiring about money and whats happening. To launch an appeal against my dismissal i will require all of my money work will be paying me. My ex is not very understanding and I don't think she will see the bigger picture on my possibly getting my job back 🙁
How long is it before the CSA can deduct straight from my pay or what is their proceddure or does that change if she infroms them I have been dismised? My last pay from work will be in just over 5 weeks which is 8 weeks from my first missed payment?
Inform the CMS the day you leave your job, this is what I had to do. You then send evidence and then go onto a £0 payment as you have no income. Arrears basically get frozen until you start working again. I’d be careful about missing payments, as they can enforce you to go on collect and pay, where you will pay an extra 20% on top.
Is collect and pay me paying them and then they pay her? Or is that them taking the money direct fron my pay? How long does it take them to deduct from my pay? How many missed oayments or ammont? My last pay will be on 1st June will they write to me first or just lift it or is there a procees they have to go through?
DEO or deduction of earnings order is taking money from your income.
The collect and pay is where you have to pay the money to CMS and they they pay it to your ex - they use this if you are in arrears with payments, but they charge you an extra 20% of your payments, which is why you want to avoid this if at all possible.
DEO what is the process for them taking one out amd how long does it take, How many missed payments or amount before they will take out a DEO?
I think they use it if they aren't having any success in collecting in other ways. They contact your employer to demand that the sum is deducted from your earnings - the employer is compelled by law to comply, I believe, and I think they only have a limited amount of time to do so, I think it's only a month or so.
i just wanted to ask you how are you doing now? some time has already passed and i'm very interested... i'm in quite same situation right now and would appreciate if you could update
The only thing I would add to this is don't leave it up to the claimant to contact the CMS, make sure they are aware of any changes quickly.
I always think it's better to write to them, keeping a copy and sending it recorded delivery. Ask them to address all further correspondence in writing, you'll then have proof of what's being said. It's often the case that when talking to different advisers over the phone, you get different advice and they don't acknowledge what had been said during previous conversations... it's just a bit of extra security.
