I have a suspended case from the CSA (started in 2009 suspended as we got back together - it was reactivated in January this year but due to their complete incompetance to get anything right Imanaged to convince the Ex to allow me to go back to direct pay (I've always paid and never tried to get out of it but she went throught the CSA as I took her to court to obtain an order as she was messing me access rights around)

Anyway I'm in court tomorrow and applying for joint - 7 nights of every 14 - my impression and according to the calculator on the website was I'd still have to pay maintenance but I've seen a couple of comments on here that suggest that may not be the case ? I cant find anything on their website - can anyone tell me if this is correct and if so point me in the direction of where I can get more info ?

Many thanks - interesting read but looks like a long road - I dont have the birth certificates (and she wouldnt let me have access to them) and if I got my 7 nights from 14 I think it would be a loooooong road for maintenance to stop.

The basics are that as you are on CSA, you will have to pay (though if you have them for over 156 days per year, it will be reduced by 3/7ths. On the new CMS, for genuine shared care, you don't have to pay, but it will be slow getting cases transferred from CSA to CMS
