HI guys

It's my first time on here and hope someone can help?

I'm about to get recalculated by the CSA and was wondering if anyone has had any success in challenging the amount they should pay based on the childrens household income?

My ex has remarried and now has at least a similar income coming in to the house as before I left the family home.

Whilst I understand that I should contribute to the kids upbringing surely there is a point of law that could argue that her new husband has accepted the children in his home and his obligation around this and that we are now in a position of Betterment and not actual need for the childrens upbringing.

To be clear I've always paid my monies and gladly accept my responsibilities under this, I simply think the system should be aimed at my childrens needs and not the Betterment of their life versus the one they would have had had I remained in the famly home?

Any advice would be great on this please

Hi

I'm afraid that the calculation is based solely on your income, and not on the income of the resident parents. The system has to deal with that vast majority of cases and cannot be flexible enough to deal with individual anomolies, plus there is the consideration that the non resident parent should still contribute towards the upkeep of the children whatever the circumstances of the resident parent.
