[Solved] Is child maintenance based on taxable income only?

Hi
Sorry if this has been answered before.
My situation may sound similar to many others.
I am newly married, I have a 17 yr old child with a previous partner who I pay via bank with agreed amount and another 9 yr old child with another ex partner. My issue is with the ex of the 9 yr old.
She has recently been informed I am selling my property and has gone into a mad jealous rage. Demanding outrageous amounts of money. I already pay her through an agreed amount. She has a career in pretending to be disabled and watching tv all day while I work my [censored] off and have never been given anything. I am self employed. She has stopped me seeing my 9yr old over wanting more money. The amount I pay I fee is fair and I’m ok with it.
At my new property I want to have a couple of lodgers to help pay the mortgage, Is child maintenance based on taxable income only? As via rent a room scheme you can receive £7500 non taxable? I feel she will try and find every way possible to get as much as possible. I don’t really want to put money from lodger into my new wife’s account if I can help it. I like security!
With a joint account will CM only take 50% of what’s in joint account into consideration? Thanks

Be very careful as there are new rules coming in in the summer with regards to savings. If you have over £32k then you will be charged 8% on anything over the top of that.

It is based on taxable income though, the CMS will look at your annual HMRC figure (usually uour P60 figure, and work out your payments from there.)

If you are on a family based arrangement then the amount will have to be agreed between yourselves. If you are with the CMS then taxable income only.

So by renting a room out and keeping it below the current £7500 per annum this will not be taken into account? As it’s up to £7500 non taxable via rent a room scheme!
Do CMS usually go by HMRC records for my self employed earnings?
Do they request them through me? Or go straight to HMRC?
Or do CMS look at my bank account without my permission?
Thank you

CMS have access to P60 earnings via HMRC.
They don't need access to bank accounts etc, as all earnings should be declared to HMRC via a tax return if self employed.

I ramped up my earnings by not including my rightful business expenses 2017-18 tax return to help with getting new mortgage so I’m guessing CMS will look at previous tax returns? Or just the latest?
Me and ex have had a verbal agreement in place up until now and I’ve been sending money via standing order.
She is not happy I’m moving out of a mouldy flat and in her eyes going up in the world. She’s stalking me and my new wife online. All gets too much sometimes feeling trapped by this woman. I’m quite close to calling the police to tell her to stop texting me continuously. I’m not blocking her as I am keeping evidence of what she is saying. This is very unfair on my child but I cannot control another adult to act decently. She is relentless and bitter towards me but she had a child with me and ran off with another man. Looking back was the best thing that ever happened. Thanks for replies. Also getting this off my chest

I'd speak to your accountant, it could get complicated. But the CMS only have access to HMRC figures, so they will use this. If you are over 25% above or below the HMRC figure then you can apply for a variation.

Sorry to hear you are having trouble, clearly your ex partner needs to move on with her life.

dont worry. if your self employed when you have more room to breathe. when I signed up to CMS, they checked HMRC records. they sent letter to both me and ex, saying my income for last tax year was 0. so I do not have to pay anything. LOL!

there was some truth to that. as I withdrew money from my company like crazy that last tax year. so accountants could not give me a salary so to speak. whatever I withdrew, they put it under dividends.

I could have just left it at that and pay nothing, according to their decision. but I just know the ex would have taken me to court (cocked and loaded with legal aid) and all [censored] would break loose! so i rang up CMS and said my income was my dividends. gave them info from my accountant, and then after nearly 3 months they worked out how much I am supposed to pay. they look at only the last tax year records.

Si179, have you looked at getting some non-molestation order or something against that crazy ex? they usually apply for one if they happen to see our shadows.
