Hi all,
Would the amount I pay in maintenance be effected by any inheritance I get?
I'd rather put money into a bank account for my son, so when he is older I could pay for school trips or new laptop for him. Even private schooling if needed.
Otherwise I feel the mother might take the extra money I pay in maintenance and spend it on herself.
(sorry if there are already 1000 topics on this subject)

I don't think it gets taken into account when calculating what you pay through CSA/CMS but I could be wrong, the only thing that may come into it is if it's a very large sum of money as it would show as an assett which I think the newer CMS system do take into account.
I would give CSA/CMS a call and just ask them to confirm, I have always found them to be quite good on giving advice.

I have moved this over to the Child Maintenance Board so that Child Maintenance Options can comment if inheritances are accounted for during Maintenance Calculations.
It may be worth you giving CMO a call on 0800 988 0988 to find out.

If you have a family-based arrangement in place it would be between you and the other parent to discuss and negotiate what is included within your agreement when calculating child maintenance. Family-based arrangements are not legally enforceable and there are no strict rules or formulas to follow when calculating child maintenance. Therefore parents can decide the terms of their agreement to suit their current circumstances.
If you have a case with the Government’s statutory scheme you may wish to contact them directly to discuss your concerns regarding if the inheritance you receive would affect the amount you pay. You will find their details on any letters they have sent you or on Gov.uk at https://www.gov.uk/child-maintenance.

If you have a Consent Order/Minute of Agreement in place you may wish to see what is stipulated within your agreement regarding your payments. Alternatively, you may wish to seek legal advice.
