Hi all
My case recently transferred from the CSA to the CMS but I have a question,when I was assessed by the CSA they didn't take the Industrial Injuries Disablement Benefit into account but in the How We Work Out Child Maintenance step by step guide sent to me by the CMS states that they seem to.

The paying parent pays the Flat rate of £7 a week for child maintenance if:
their gross income in £100 or less
OR
they receive on of the following benefits:
long list which includes
Industrial Injuries Disablement Benefit
My question is although I earn a good wage and pay the amount assessed directly to my ex-wife if I declare that I get IIDB (which the CMS booklet says they automatically get information about) will my wages be ignored and only have to pay the Flat rate?
Can anyone advise me if my interpretation is right or will the benefit i receive just be added to my Gross Income and I will just pay more?

This is out of my experience I'm afraid, hopefully someone will be along that ca advise you on this. Failing that, you could try the CAB, they may be able to help.

I'm not sure - I have the feeling that may be correct, but I'd check with CAB as suggested above. However, if it is correct, I'd still consider putting some extra moeny in on a voluntary basis as it is still your child that needs supporting.

It's not taxable so will not show on hmrc amounts like your wages do
