[Solved] Incorrect calculation by CMS

Hi, Guys.

So, HMRC made an error and for the tax period 2017 to 2018 said that I was earning 25K.
It was caused by HMRC thinking that I had a company car and fuel card from my previous job.
CMS calculate what you earn before tax, my annual wage before tax is 20K then the car has a worth of £2500 and the fuel card has a worth of £2500 (not actual figures here but you get the drift) therefore total taxable income is 25K.
However because I changed jobs and no longer have those benefits, but HMRC didnt take those benefits off of my figure my actual income was 20K for 17 to 18 tax year.
As this error was discovered after April which is when CMS calculate the payments, CMS was using the figures of 25K.
I spoke to HMRC who rectified it in July 18 as they had to wait for my previous employer to submit the P11d for which confirms what company car and other benefits I had, when the started and finished.
Subsequently I received a TAX refund.

Here comes the annoying part!

Trying to explain to CMS that they have calculated incorrect figures is next to impossible.
I totally understand that if I had taken a pay cut then they would not recalculate it unless it was a change of more than 25% (which is way to much if you ask me) but the fact that they have used incorrect figures that is not my fault and it equates to me paying way more than I should, on money that I never earn't ever!! Then that's just criminal and unjust.

So, I have done the appeal, and mandatory request of which both were denied by CMS. (They simply couldn't get their head around it).

I am now requesting a Tribunal.

If anyone has any tips or could help or advice, much appreciated. I will keep you updated.

This is unusual, to say the least. CMS did their original calculation correctly, on the basis of information provided by HMRC, so you may have a cause for a complaint against HMRC as you have suffered a financial loss due to their error.
