[Solved] Inaccurate Arrears

Hi All,

I wanting some advice on an issue that recently came about. I got divorced in 2008 and was currently in the Armed Forces, so regularly paid CSA. In 2012 i was made redundant. At which point i stopped paying CSA but when ever my son needed anything i provided. I have been unemployed since 2012, i have children with my current partner and became an at home father.
Recently i have received a letter form the CMA telling me that i am to be taken to court for not paying any CSA for the last 5 years, even though i told them that was unemployed and that i did not claim benefits. Though when my son visits he still has anything that he needs. THE CMA are using the payroll figures for 2012/13 when i was still in the armed forces to work out there calculations for the last 5 years.

How can you claim money that i havent earned??? What makes it worse is my ex is the one that put in for the claim knowing i was not working. In total they are taking me to court for £13,500.

Seriously, how can they do this?? It criminal!!!

The CMS are law unto themselves... as you're unemployed I didn't think you'd have to pay anything, but perhaps the fact that you're not receiving any benefits leads them to conclude that you must have some form of income.

I'm not all that clued up as far as financial matters are concerned, hopefully someone with more knowledge will be along shortly.

Do you have any evidence from the CSA that you notified them of the fact that you were unemployed? If not, I would complete a Subject Access Request for the CSA for all documentation, as this will hopefully give you some evidence to back you up. I would hope, that since you are being taken to court, that this would actually be a good thing from your side as you get a chance to argue your case and a decision will be made by the court, not just by the CSA.
