Hi I have my kids 50% of the time 4 nights one week 3 the week after . My ex gets all the benefits and I get nothing it's been like this for 2 years now , I was just wondering why It should be her that gets all the benefits if we split everything 50 50 ie school clothes ect . There doesn't seem to be a way the government can share it does anyone have the same problem or a solution to make it fair?? I know if I got all the benefits it wouldn't seem fair to her ??
Thanks 🙂
Hi there
Unfortunately, as far as the benefits are concerned, they won't split them, although you could apply for a child each, or agree that one parent claims the child benefit and the other the tax credits, but it will have to be through agreement with the mother.
Give the Child Benefit office a call and speak to them, they may be able to offer further advice.
Are you paying any Child Maintenance? If you are that can be tricky too, unless the mother is honest about the 50/50 shared care. They would rely on the fact that she is receiving the benefits, as proof that she is the primary career, they will also accept a court order that states that care is shared equally too.
Best of luck
