Hi, I separated from my ex GF about 8 years ago and have paid fully each month since then.

My son came to live with me a year ago and things are starting to become very expensive as I still have to pay for my other 3 children. My ex does not contribute anything for my son and the CMA say as she doesn't work (never has) she doesn't have to.

Can I appeal against this / get a reduction in the money I pay to her?

How come I work and pay for everything and she gets to sit back / remarries and not pay a bean?

Its really starting to get me down.

Hi There,

If your ex isn't working then in effect they can't take anything from her, if she recieves benifits I did think that they could ask her for a minimal payment, but it's such a small amount that it probably won't help you much, I think you are stuck at the moment unless you could get her to pay volentarily which by the sounds of it she won't.

If you have a family-based arrangement in place you may wish to speak with the other parent regarding your maintenance payments. Family-based arrangements are not legally enforceable and there are no strict rules or formulas to follow when calculating child maintenance. Therefore, parents can decide the terms of their agreement to suit their current circumstances.

If you have a case with the Government statutory scheme you may wish to speak to them directly to discuss your concerns regarding case and your payments. You will find their details on any letters they have sent you or on Gov.uk at https://www.gov.uk/child-maintenance.

If you have a Consent Order/Minute of Agreement you may wish to seek legal advice as to where you stand regarding your payments.

For more information on the different ways to set up child maintenance, you can visit the Child Maintenance Options website at http://www.cmoptions.org.
