Hi
I am new to this page I am looking to get advice if i am to change my wages to go into my girl friends bank can CSA still still take money from there , I have spoken to CSA on a number of occasions as My ex has told CSA that I have never paid her anything but i had been paying her every month up until a few months ago when she stopped me seeing my son for the most stupid reason we had arranged to meet sunday but she had asked me to text friday and as i am at work alot i lost track of the days and text her on thursday instead of friday and she then said that the text didnt count and i have not seen my son since easter she has stopped me seeing my son on alot of occasions , first was as i met my new girlfriend , then because i got called into work , then because when my daughter was born i was stuck in oxford hospital for 3 months as she was born early at at 1lb 2oz she said i had chosen my daughter over my son , this time was the last time i was accepting it so now i have told her and CSA i refuse to pay anything till i see my son , but as she has lied to CSA that i never paid they say i owe her thousands and started to take £300 a month from me , i have messages between us arranging for me to give her money but they say this is not proof , i would rather go to court and show what type of person she is than pay if i have to pay this i will need to quit work as i cant afford rent my other children and transport to and from work , any help would be great
thanks
Hi
It doesn't make any difference where your wages are paid to, the CSA will still demand payment based on your income (and it's irrelevant to them whether contact has been withheld as maintenance and contact are separate issues). If you have been paying by bank transfer, then provide proof of your bank statements of regular payments and argue the point.
If you refuse to pay, it could get worse - once the case is transferred to the CMS, then you would almost certainly run the risk of going straight on to collect and pay, and this means that the CMS will add a 20% charge on top of your payments.
they have already gone to collect and pay even while i was paying my ex has told them i have not so they take £300 every month and because she asked for cash i have no proof but csa just take her side of things , i have now changed where my wages are paid to as i would rather go to court after everything she has done
