Hi Guys,
I thought I’d join and ask the question as I suspect there will be thousands of Dads in the same boat as me and someone might be able to help.
My wife who has no integrity, has set up a limited company and as a consequence of hiding behind this evasion of tax, I receive the grand some of £10 a week for my daughters when I and everyone else can clearly see from companies house details that she has several hundreds of thousands in the company accounts.
I have mentioned this to CMS and a case was raised 3 years ago but heard nothing.
Any nuggets of wisdom anyone ?
Cheers
Well in my case as the Director of a Limited Company, my ex requested a tribunal on the grounds of undeclared income. She could also have asked for diversion of income, through either keeping it in the company as profits, or excess pension contributions.
I had no say in this, she appealed to CMS, I was informed that I was going to tribunal where they would ask for all of my full accounts and the judge would likely make a decision based on what it appeared I had been doing. In fact the tribunal was cancelled, but not relevant to the main point you are asking.
So based on my experience I would say, contact CMS and tell them that you want to take her to tribunal. I think you need to produce some evidence however that she is doing what you are saying. Not sure if the micro accounts you see on line is sufficient. It should be in my opinion as it will show what surplus cash is held by the company.
Many thanks for your reply and background info which is really useful. I’ll contact CMS and hope it’s not another 3 years before the girls receive what’s rightfully theirs.
Cheers
