[Solved] Help Please. THIS DOESN'T MAKE SENSE!

Hi All,

First contact I had from CMS is when they had DOE of almost £600 from my Salary.

I called them, I was advised they tried to contact me from my last address and made the decision from lack of response. This I understand.

I was asked to pay for a DNA test which I complied and the result stated "I was not the father". CMS cancelled the DOE.

What was shocking was this woman that I know nothing about listed the child name with my surname at the end on the DNA test document.

Me and my wife had a little girl last week and I had to take my passport to be listed as the father on her birth certificate. How did this woman find my name and how czn she give my name to the child? This I don't understand.

I was notified that the DOE will resume because there believed I didn't take the test.

I asked why? I had my passport, driving licence and gave the person taking the test a copy of my photo. This is the process which I followed.

I was told unless I agree to interview under caution and a retest the DOE stays.

So a woman I don't know gave her child my last name, advised CMS I am the father, gave them my previous address, DNA proved I'm not the father. But CMS claim I did not carry out the test.

I called them again and spoke with the Financial Investigations Team (their calls are not recorded). I was categorically told they believe I am lying and the head of financial investigation seems to take this case really personal.

I did some research and found he was an ex met officer that had a chequered past. I have had bad experiences with Police especially ones with agenda and something stinks here.

I initially agreed to their terms but after reading about his history and the culture at CMS I choose to go through my MP, Resolver and their complaints department.

I wrote to them September 2018 and still no response. I had a Service Action Request sent. Ignored. But what was interesting is when my daughter was born I sent a picture to the head of financial investigation and promptly got a reply about that particular email but still no response from my complaint or action request.

I have evidence this child is not mine
I don't know the woman
Yet CMS have DOE on my salary.

Is this normal? It seems No one at CMS have an issue with this and I am consistently been referred back to the Head of Finance Investigations.

What are my options that I have not exhausted and how do I do about exploring them?
Please Help. This is driving me insane

This sounds like a proper mess to be fair, did you use an accredited DNA testing service? It might be as well to have it done again with one of the companies that the CMS recommend, it will cost a bit, but at least it will settle the matter once and for all. You may be entitled to a refund for the cost of the test.

It seems to me that if you’re not the father, then you have nothing to fear from an interview, or further testing, it’s probably better to comply as this will be the quickest route out of this situation. You’re dealing with a Government body and people rarely get the upper hand with them. You could go speak to a solicitor, or the Citizens Advice Bureau, but I think they’re likely to advise you to do what’s been asked of you to resolve this.

Whilst I understand that you are wary about the head of the Financial Investigation Team, he is a Government employee and accusing him of underhanded practice, without actual proof might not be in your best interests.

What does your MP say about your situation?
You’re right that she couldn’t have put your name on the birth certificate without you being there, but you wouldn’t need to be on the birth certificate for her to make a child maintenance claim, naming you as the father.

I paid for a CMS recommended Cellmark. I gave them all the control which is what has shocked me.

They told my MP they are investigating it.

I feel if I comply they can sweep this type of behaviour under the carpet.

Effectively they are taking money out of my pay for a responsibility that is not mine, because they are a government body I cannot do anything.

All I want is transparency. Its even part of their terms if suspected to be financial motivated they will deny the claim.

What do you call this?

A woman I don't know
A DNA Test from accredited Cellmark that states I am not the father
A Head of Investigation that seems to have a vested interest.
But in a country with laws that can be ignored and no one can do anything about it.

I'm at a loss tbh. But until they are transparent I refuse to take the second test. I have assurance they will refund my monies if the second test prove to be the same.

But something stinks

I just found out why all of this is happening. That makes sense to me anyway.

CMS REFUNDED ME TWICE FOR THE DNA TEST.

They demanded a refund. I told them to take it out of the liability order they already took.

The mgr told me the case will remain open until I pay. I dismissed ger. I already have a DNA test certificate.

Next Liability order and demand for retest.
