Help, impossible to get CSA to listen !!!!

My 19 1/2 yo daughter was a part time student 5.5hours a week, and works 24 hours a week. i have requested the Child maintenance service review the case in order to bring the case to a close (i have dutifully paid for 15 years). 

This was when the problems started, the CSA state that as PWC receives Child benefit then she is also entitled to CSA payments -

i appealed this decision and was rejected as insufficient evidence was provided that daughter wasnt in full time education , i have asked for a mandatory reconsideration and provided an email from the head of the educational establishment stating that daughter no longer attends college, i have also provided details of daughters employer. again this was rejected, this time because PWC receives CB ? 

I have contacted CB who state that PWC says she is entitled so there nothing they can do about it - I then reported her for fraudulently claiming CB (this report goes into a black hole) 

in the meantime i continue to pay £500PCM - what on earth can i do when government bodies dont/wont investigate properly - as this is clearly fraud am i guilty by association ?

Hi,

 

I have just been through an almost the same situation. I am not a dad thought, I'm the mother.

My son lived with his dad for 18 months and returned to live with me in August 2022. He left full time education in June 2022. I reported the changes to CMS numerous times over the course of a year. These kept getting rejected because my ex husband continued to fraudulently claim CB. I reported benefit fraud countless times but this was not investigated. I was threatened by CMS for arrears of CM because my ex husband reported me for non payment which he knew he was no longer entitled to.

I provided evidence to CMS but they would not consider it, instead taking my ex husband lies as evidence over the physical evidence I have provided.

For a year I was banging my head against a wall with CMS to the point I felt suicidal. I got my local MP involved but CMS stuck to their guns. I had to take it to appeal, which was heard last week, almost two years after i first reported the changes. The judge ruled in my favour thankfully. The hearing lasted less than 5 minutes. The judge concluded that payment of CB cannot a determinative factor in liability for CM, particularly when in it paid in absence of legal entitlement. Nobody from CMS even bothered to attend the hearing.

The system is completely bias towards the receiving parent. It is not a fair system at all. How is it right to treat people this way. CMS allowed my ex to continue to abuse me by abusing the system. Why was I treated like the villain when it was my ex who committed a criminal offence. Yet, nothing will be done about him.

Where do you go when nobody listens of takes your reports seriously.

I wonder how many more people have suffered the emotional torment and trauma that I have endured over the last two years

 

I agree with getting your MP involved to raise a complaint. They can't ignore that. It might not get you anywhere other than a response from CMS. Also lodge an appeal with HMCTS if MR is rejected.  It can take some time for the actual hearing but the judge can't ignore the evidence like CMS do.
