Very helpful, William -- thank you. One more question -- the court arrangement ( April 2004) set out provision for child maintenance and also another provision for school fees. Both of these were unreasonable -- even at that time , and rendered even more so when I sold off my business and advised her of a 'material change in circumstance'. I now pay £500 per month ( and have done since 2005) but she never says or acknowledges what she deems this to be for. When she says she needs more maintenance, she claims the 500 is used for school fees and when it's convenient to use school fees as a weapon, she claims the 500 is used for maintenance. Can the CSM's ruling also override the school fees clause? ( as well as the maintenance) My opinion at the time -- when my business terminated -- was that we should pull both our kids from private school. She wouldn't do that -- but blamed me -- and continues to -- for her having to shoulder the fee burden. My opinion was that private school is a luxury, but if you can't afford it, there's no shame in saying so. But she continues to force the issue and makes school decisions with consulting me.

For background -- she ended up with our house worth £500K -- she has no mortgage, a job paying 50K a year and a new partner living in the house. I just can't help feeling that I'm being treated very unfairly.

Hello Mark E

The Child Maintenance Service only deal with child maintenance, you can find more details about how the Child Maintenance Service work and how they calculate child maintenance on the following link, https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/325219/how-we-work-out-child-maintenance.pdf.

If you have any further queries regarding the children’s school fees and how this impacts your maintenance payments, you may wish to speak to the Child Maintenance Service directly. Alternatively, you may want to seek legal advice.
