[Solved] Having to pay new CMS charges!

Hi

Cms wrote saying I can't pay the ex direct and will incurr charges, apparently it's in the childrens best interest?

I've phoned to question it, they say not having 6 clear payments is the reason. I've only been paying through them for 4months so It's impossible for me to meet the criteria??

Is there any further I can take this or have I just got to put up with it?

I would go and see your MP straight away and ask them to take it up. Otherwise, at worst, perhaps you pay 2 months by collect and pay and then tell them that they now have a record of 6 months. Having said that - what do they do with a new case where there haven't been any payments at all, so no history - it definitely isn't right what they are doing in your case.

Thanks I'll try that and see if that has any affect. You would have thought common sense would prevail!!.... I've tried calling them again but now there computers are down and can't help me any further till Monday!!!....

...everyone that is signed up to the new scheme is permitted to pay direct unless they default and have arrears. If you have paid on time each month then you shouldn't be moved to collect and pay.

Just stick to your guns, keep asking to speak to the manager...and yes get your MP involved as actd suggests.

Did you have a private arrangement before the CMS contacted you? If you had it going out of your bank privately offer to prove that you paid on time everytime voluntary.

To get clarification and an answer to your question, you do really need to get back in touch with the Child Maintenance Service and ask them about their policy surrounding the clear payments rule. You can find their details on the https://www.gov.uk website or on any letters you receive from them.

Thanks for your help.... I wrote a letter of complaint and got my MP onto it. In the end my case worker agreed that as I had always paid before the CMS and that I had also paid everything they had asked I could move to direct pay!!... They reckon because my payments showed up as all over the place due to fault on their part I was initialy refused.
