[Solved] Getting Conned out of Maintenance!!!

New on here folks so thanks in advance for any helpful advice.
I was left with my three children when my ex-wife left us 3 and a half years ago. But 2 years ago my daughter decided to go live with her mother after we had a falling out, She hasn't spoke to me since and refuses to see me. Neither her or her Mother will contact or see either myself or my sons.

Now I have been paying over £55 per week Maintenance for her from then. It has been a major struggle to afford it as a single Dad still paying all bills and rent and looking after 2 boys. Literally living on the bread-line to keep our chins above water. All the while hearing that my ex is going on 3 holidays a year and numerous weekends away... Even a Cruise later this year. All on a waitress wage!!!!

I have just learned that my daughter has not been in full time education for quite some time now, even though I have still been paying maintenance. Her and her mother conned me into thinking she was still in full time education. I have now stopped paying and not heard anything from them....

My question is... Can I claim any of those payments back? I could really do with being able to afford to do something worthwhile with my boys for a change!!!

To be honest, it's not something I have much knowledge on I'm afraid.

How were you paying her? Privately or via CMS?

I was paying privately, but the amount that the CMS had told me I was eligible to pay her.
I certainly couldn't afford another 20% and let them take it out... Already in enough debt by doing it the right way!!!

You won't be able to claim the money back from her unless you go through a small claims court, though I would rate your chances as very slim. However, can I clarify - you have 3 children by the same ex wife, and 2 of them are still living with you? Is your ex working? If so, then open a case with CMS and put in a claim against her for maintenance for the two living with you - you are certainly entitled to it.
