Hi,

I have found this forum today whilst trying to find some help for my case!! Any help would be so appreciated!

Let me explain as briefly as possible.

Son will be 18 in June. He signed up for (yet another!!) college course in Sept but dropped out in November. He has not attended since. His mother did not let the child benefit know. However last month he started a part time job which has become full time now. I decided that now my maintenance is not justified and contacted the Child Maintenance Service to let them know. I also reported the ex to the benefit fraud team. I heard nothing, and the CMS just kept saying 'he gets child benefit so need to pay maintenance ' over and over again.

When I spoke to child benefit people, they told me he is 'off sick' from college and as his mother says he might go back in Sept he still gets child benefit. I told them he is working full time now. They said ring fraud line again.

I corresponded with my MP who wrote to them. Today he has sent me the copy of the letter that the child maintenance team sent him. It says the child benefit team have decided that he is still entitled to child benefit as his mother says he might go back to college in Sept.

How can this be right?? Not attended college at all since November and now in full time employment!! All this on the basis that he 'may' return in Sept. I have spoken about this with my son and he hasn't got a clue what he is going to do in Sept. Probably stay at work seeing as he is enjoying it!!

Can anyone tell me what I should do now? I feel it is so wrong and am banging my head up a brick wall.

If you aren't happy you can ask your MP to escalate your complaint to the Parliamentary Omsbudsman.
Due to parliament being dissolved at the moment you may need to wait until after the Election, I'm not sure though so have a look on their website for more information about this

Hello and thanks for replying. Yes, I believe I need to wait until after the election - my MP did mention this.
