Hello

quick question, if anyone knows the answer, can a lady force collect and pay on you, even though you haven't missed a payment. and therefore enforce the extra charges on you?

Hi Tom

I don't think they can, here's a link to our Maintenance section.

Thanks Mojo, link seems to suggest I have to miss payments first.

...that's how I understand it, but sometimes the CMS don't understand their own guidelines! If you get a problem I would call them to discuss it.

Good luck

Hello tom_b

The Collect and Pay scheme is only usually used when there is a specific reason, such as missed payments. When a new application is made with the Child Maintenance Service, either parent can choose to use the Direct Pay option initially.

You can find very detailed information on how the Child Maintenance Service work here, https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/325219/how-we-work-out-child-maintenance.pdf

The Child Maintenance Service are just one available option for arranging maintenance payments. If you would like more information on the options and a more personalised service, you can contact Child Maintenance Options directly, http://www.cmoptions.org.

The Department for Work and Pensions (DWP) have a web application, ‘Sorting out separation’. It aims to make it much easier for separating and separated parents (and childless couples) to find the support they need, when and where they need it, and encourages them to collaborate on a range of issues. The link is http://www.dad.info/divorce-and-separation/sorting-out-separation

Regards

William
