Hi, i wonder if you can help with some advice for my partner, she has 2 kids 11/13 years old. Her ex husband has not been paying maintenance. he made the odd £200 payment but for the last 12 months nothing at all. She contacted the CMS who to cut along story short said they will collect the money from him/his employer directly from wages. He has a job in authority. He owes £3000 in arrears and a payment was due this week of £300 as part of the regular monthly payment. She received a letter to say they have not been able to collect payment and he hasn't paid. How is this possible? if you are in employment i thought the employer had to deduct it from salary and pay the CMS. This is causing financial hardship and she is having to borrow money on the strength of the debt in order to live. Can you advise how this, or why this may be happening please? top of bottom of this is somehow he always seems to wriggle out of paying yet he has a job working for a local authority.

It possible your ex changed Jobs. If he is not keeping cms informed of job changes then cms will be trying to track him down, which could explain the delays with payments
I'd certainly contact CMS to try to get an explanation from them - happened to me a long time ago when my ex suddenly left work to avoid paying maintenance.
