[Solved] ex-wife's big salary

Hi, I have been regularly paying my ex-wife child maint directly (not through CSA) for several years and the amount is more than fair but my ex constantly uses a threat to go to the CSA to get even more (greed)... She earns £60k+. My question is; is there a rule that says she can't claim child maint if earning a certain level or more than her ex (me)?

No there isn't unfortunately....you can get a calculation of the amount you should be paying, sometimes it works out better for some paying parents to go through the CSA as they find out they have been paying over the odds! Just google the CSA calculator, input your details and you will be given an amount that you should pay.

There's also a sticky at the top of this section called "how does the CSA calculate payments" it might be helpful to have a read through this.

Hi There,

NJ is right there isn't a rule that says if the resident parent earns over £xxx you don't have to pay.

I understand how this must feel but the money is for your child and not your ex. The amount your ex earns shouldn't come into what you pay.

As NJ says look at the CSA calculator and work out what they would award her if you went through them. You can use this as a guide and a way of starting to fix the amount you pay.

If you go to the CSA yourself then it will remove the threat.

Thank you for your post, I am William the Child Maintenance Options consultant. The information that Nannyjane has provided is correct, there is no such rule. The Government Statutory Scheme calculates child maintenance by using the following information:

the paying parent's net/gross weekly income
the number of children that child maintenance will be paid for
the number of nights a year, on average, the paying parent has care of the child(ren)
the number of other children the paying parent supports
if the paying parent receives benefits

There are many other financial factors that may be taken into account by the Statutory Scheme when calculating maintenance, so you may wish to speak with them directly about your concerns. Their contact details can be found on the following website http://www.gov.uk/childmaintenance. You may also find further information on how they calculate maintenance.
