The arrears will build up for a small amount (sometimes can be a large amount if takes ages to contact you) as they have to give you 30 days notice to make payment and the arrears will be for a partial month that you would be liable for. Everything is worked out from when the claim was opened but if it takes a while to speak to you then they still have to give you notice to set up Direct Pay... However they will spread this over the 12 months and as long as you pay all instalments as advised you are fine.. Hope this helps..

I have been paying my ex equiv monthly child maintenance since early 2019. In addition I’ve been paying the mortgage on the house that she still lives, which is £1900 p/month. My maintenance amount is just over £900. If I defect half the mortgage she gets nothing…so I stead I’m paying her £335 which I took from her court submission and was the cost of children from her income needs.
I suspect she’s getting the CMS involved now.

What should expect and how do I prepare?

@stevenh CMS will do their calculation based on your income alone, though they should also deduct your mortgage payments from your income as part of the calculation. It's worth going on the child maintenance calculator to get an idea of what you will pay. CMS will replace the any court order if it's more than 12 months old.
