Hello. My circumstances are that I have an 8 year old boy and I pay CHild maintenance monthly payments. We were not married. She now has a solicitor asking me to “agree to disclose your financial position and assets to her in the hope that an agreement can be reached regarding the maintenance” because my payments are low at the moment because I am on universal credit. I am worried because I own a house in my name.
Any help would be much appreciated
Hi
Do you pay Child Maintenance via the Child Maintenance Service? If not you can open a case with them and ask them to calculate how much you should be paying {it costs £20 to open case but very worth it) . If you have then legally you only need to pay what the CMS say you should.
If you are on Universal Credit then you only need to pay the flat rate of £28 per month. The amount you pay is based on your income and not your assets. Unless your assets also generate an income eg rental property.
Sounds like her solicitor is trying to scare you and is just fishing..
Hope this helps..
I agree - if she thought she could get more out of you under the CMS rules, she'd have opened a case herself with CMS and saved herself the solicitors fee. Open a case with CMS as suggested above for £20 and let them calculated the total, plus you don't have to disclose your financial details to her.
