CMS case first time opened in Dec 2015, calculation based on the tax year of 2014-15 of which is £57185.69
then the case was closed in June 2016, due to the mother's drinking and rehab and a temporary change in custody.
case opened again in Nov 2016, which the calculation should be based on the tax year of 2015-16 of which is £44023.40, However, i'm told that because there was a (small) employment gap due to me changing jobs in 2015-16, the CMS has a rule of not using that figure but to base it on the last figures they have on file, which is the previous tax year in which I earned substantially more ( £57185.69,)
is it true about this employment gap rule??? because it seems very unfair, as i'm not earning what i used to earn in 2014-2015, but i'm paying CMS based on that amount!! My next annual review is November 2017. Will they then use the 2016/17 tax year or keep using the 'file' figures if the difference is less than 25%??
indeed there's a lot of unfairness in the new system, we as fathers are not trying to avoid the responsibilities of raising the children, but the end we also need to be able to feed ourselves and also need to be left with some money to spend when the children are over, perhaps even going on holidays with the children if a reasonable system provided. now the mothers get to take them on holidays simply because they can afford it, but we can't.
i've submitted the petitions a member in this site has started, great ideas!
I'm not too well clued up with the child maintenance side of things, but I thought you could ask for a variation....I also thought that if the difference between what you earned and are earning is more than a 25% difference then they do take it into account....looking at your figures, though you're very slightly under that threshold.
Hopefully someone more knowledgeable will be along soon to help.
