Hi all,
I am currently in discussion with CMS over an incorrect calculation done by them and whilst i am at it was wondering if anyone could help? My query is over additional educational expenses that are split 50/50 as part of a consent order. Am i able to ask CMS to take these into account as they form part of a court order?

I think you can ask for a variation if your child is at boarding school, but only for the everyday expenses, not the fees. These are called special expenses.
If they can't look at the extra you pay, you may have to return to court if your circumstances have changed and you want the order to be varied.
When there's court ordered maintenance, once the order has been in place for over 12 months, either parent can open a claim via the CMS and this overrides the court order. As you are already dealing with a CMS claim,it's possible that the order can be overridden. There's no harm in asking them.
