Do I still have to pay CSA if my 16 year old daughter has had a baby?

Hi there

It probably depends on if she is in receipt of any benefits, or no longer lives with the mother.

I'd like to move this thread into the Child Maintenance section, our CMO expert may be able to answer your question.

It might be a good idea to give the CSA a call, the CAB should also be able to advise you.

My 16 year old daughter is still living with her mother and is now in receipt of state benefit however she will be going back to school.

Hello Nk1310

Under child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid. When a child leaves full-time education in the summer, Child Benefit generally continues until the first week of September.

If your daughter’s mother is still in receipt of the Child Benefit for your daughter then you may still be eligible to pay child maintenance. I have included a link on the eligibility for Child Benefit that you may find helpful, https://www.gov.uk/child-benefit/eligibility.

If you have a family-based arrangement in place you may wish to discuss and negotiate with the other parent your maintenance payments. Although, family-based arrangements are not legally enforceable, parents can decide the terms of their agreement to suit their current circumstances, as there are no strict rules or formulas to follow.

If you have a case with the Government’s statutory scheme you would need to contact them directly to see where you stand regarding your payments. You will find their details on any letters they have sent you or on Gov.uk at https://www.gov.uk/child-maintenance.

If you a Consent Order/Minute of Agreement in place you may want to see what is stipulated within your agreement as to where you stand regarding your current circumstances. Alternatively, you may wish to seek legal advice.
