Please someone help! My ex has a claim open on me through cms, but I’ve requested a dna test to be done. Cms have told me if she doesn’t respond to having the dna test done then they assume I’m not the father and the case would be closed? My question is does anyone know how long she would get to respond back to them from the letter being sent out? It’s been just over 3 weeks since I told cms! Surely that’s plenty time to respond to a letter, most letter would normally be 7-14days. Thanks in advance

Unfortunately the CMS can be really slow moving, it can take them weeks to sort out a claim, which can often leave the paying parent in arrears on the payment start date.
Have they made the calculations in your case? If they have, you will be expected to pay the calculated amount until the results of the DNA test are back. If it’s found that you’re not the father, they should reimburse you.
I’ll link you with some further info about it.
You’re going to have to be patient I think, if you have a point of contact at the CMS, maybe call them for regular updates.

Hi, thanks for your reply. The case has been open for while now, I’ve been paying for the child but I’ve now just only been told I might not be the dad. So told cms this and they opened dispute of parenting. To which they then have to ask her weather she agrees to dna test being done. Then I’m being told that then if she does then I’d be contacted by cellmarks to make payment of dna test and then book appointments ect. I did ask weather what if she doesn’t respond to the letter? They told me that’s basically saying I’m not the dad if she doesn’t agree, to which they have no choice but to close case against me. Been over 3 weeks not heard from cms, cellmarks or ex. How long would her deadline be to respond to agree on dna test.
@Teddy I’m in the exact same predicament, can you tell me how long it took you before she responded? Was the case closed?
