Jan last year I was contacted by cms and said I had to pay maintenance for a child that I had been named the father.
Ive asked for a dna test through the child maintenance service and told them I cant afford to pay for it Β£150. I have two children I pay for direct to my ex wife.
To this day im waiting for reply from child maintenance service who said they will help me and they continue to say I owe money. Ive never admited purturnity or been offered a dna test. Basically cms is going on a womens word thst this kid is mine. Which is not possible.
What can I do?
Hi
I'm afraid that, as far as I know, you have to pay for the DNA test yourself, and if it comes back negative, then they should refund you the cost. Until you get that proof, you will be accruing arrears in maintenance for this child, and that continues to be owed even if the DNA test proves negative, it only stops accruing from the date of the test, so the sooner you can arrange to get the test done, the better it is for you. If the child's mother refuses to allow a DNA test to be done, then that is also taken as being a negative test.
