My partner has a 14 year old son who he pays maintenance for, we have a 7 year old daughter too, child maintenance have been taking 40% of his wage each month, last month we were left with £880 and £588 was taken for child maintenance, we cant claim any benefits due to my partner's wage being over the threshold last year, and after out rent and council tax were paid we were left with nothing to live on, I have spoken n to CMS numerous times as they have my partner down as earning £600 a week, he earn £362, CMS are no help, all they say is " we will take 40% each month" we are in serious financial difficulty now and owe a fortune to family friends and loans, can anyone give us any advice on what we can do, ? Also for the last 7 year we have been telling CSA that we have a daughter but they never put her on the system, when I spoke to CMS 2 weeks ago they also did not have our daughter on the system, we am left with no choice but for my partner to hand his notice in at work and claim benefits as we will be £800 a month better off,

This is awful, I have always found CMS and CSA quite good each time I call them, but we do hear horror stories like yours.

Have they explained why they feel your partner earns what they say he earns?

Hi, a few month ago CMS contacted his employer and asked for that months earnings, my partner had some overtime on and holiday pay on so they calculated his monthly rate as that, we've told them numerous times that was a one off and we've sent payslips through the self portal thing to them, this month my partner has had to take unpaid holidays as work is very slow at the minute so we're worried sick we won't be left with enough for even our rent next week let alone money to live on , we really don't know which way to turn, our local mp has asked the complaints person to look into this but I'm not convinced it's going to help us

I have been paying child maintenance since 2009 . Never missed a payment . On 24/11/17 They took me to court saying I owed arrears of £1811 so I made an offer of £80 a month manager of csa agreed and put it forword to the judge which was all agreed . Been waiting for them to get in touch for payments and court agreement. I Hurd nothing until 16/12/17 . The letter saying pay full amount ammediatly. I am so confused with this . Csa manager asked for three copies of the court order but I've not received any think from the court or csa.
Can any body give me any advise on this please .

I’m sorry if I’m being naive and too obvious, but in both cases, have you tried talking to the person who is receiving the money, explaining the situation and asking them for help ?
I think if they are on your side you stand a better chance.
