I am currently paying child maintenance through a private agreement with my ex. My daughter will be 18 in June and I know that I am legally bound to pay maintenance until she finishes the school year. However do I still pay maintenance throughout the summer until she start university.
I will be assisting my daughter with regards to travel costs etc but at least I will be paying that straight to my daughter but when do I legally stop paying maintenance to my ex
Hi, here's a link to the CMO website that has further info
http://www.cmoptions.org/en/faqs/section1.asp#Q3
Child Benefit or Tax Credits etc stop being paid at the end of August if that helps although Uni and Finance do not begin until the start of October.
Hello Rickd
As you currently have a family-based arrangement in place and there are no set rules that you must follow with this type of arrangement, you and the other parent have the freedom and flexibility to decide together when your arrangement should come to an end.
If you would like to base your arrangement on child support legislation, regular child maintenance payments must be made until a child is 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid. When a child leaves full-time education in the summer, Child Benefit generally continues until the first week of September.
You can find more information about when child maintenance and Child Benefit stops on Gov.uk at https://www.gov.uk/when-child-maintenance-payments-stop.
For information on child maintenance arrangements and for a more personalised service, you can visit the Child Maintenance Options website at http://www.cmoptions.org.
The DWP have a sorting out separation web-app that you may find useful. It offers help and support to separating and separated families. The link is: www.dad.info/divorce-and-separation/sorting-out-separation.
