Hi I currently have no contact with my son, difficult circumstances. At the moment I have a private agreement with his mother.

I have the chance of a contract offshore, paid Gross out of the UK and claiming seafarers tax relief.
Will the CSA assess this income as earnings?

If the wages are paid outside of the UK it would depend on whether we have a reciprocal arrangement with the country where your wages are being paid.

If you have a workable arrangement with the mother, I see no reason why you can’t continue to negotiate terms privately. If you stop payment that could see her applying to court for maintenance, better that you continue to have control of this situation.

Best of luck

I don't know about this area at all, but it seems to me that if you are getting tax relief, then the income is still taxable (it's just that you aren't actually paying tax), so for CMS, I'm guessing that they would still assess your income. If you have an agreement with your ex, then that''s the best solution in any case.

Thank you for your replies
Yes an agreement with my Ex is always best I agree.
I work in Norway at the moment and pay Norwegian tax.

As I pay no UK tax then my assessment with the CSA is a NIL status as they can only calculate net UK earnings.

I assume it will be the same situation if I am paid gross abroad then submit a NT (Non Tax) tax code this will still show that I have no Net UK income to calculate?

Im just finding out where I stand before I accept this new contract. What we have now works even though I am still fighting to see my son.

Its good you suggest court order as we may be going to court soon to sort access, how will the court calculate how much I pay?Do I have to provide them with earnings etc?

Child contact and maintenance are kept separate, family courts for contact won’t deal with maintenance decisions.

If you lived abroad and stopped paying your ex, she would have to apply to court, not sure if she’d have to open a case with the CMS first. However, if you intend to continue paying, this problem shouldn’t arise.

All the best
