Where do I start???? My daughter is 17 lives at home with my ex, my daughter fell pregnant and duly gave birth to my beautiful granddaughter 9 weeks ago, my daughter is now in receipt of child benefit and child tax credits and awaiting her income support, I have rang the CSA and in all fairness have been understanding and contacted the DWP to see if my ex was still in receipt of child benefit. As of now it is still down on the DWP database that my ex is still in receipt of child benefit for my daughter till September 2016, the DWP if you can get through are about as much help as a chocolate tea pot, surely if my daughter is in receipt of benefits I shouldn't have to pay CSA??????? HELP this is really doing my head in and my ex is laughing all the way to the bank..........oh and CSA contacted my ex Wednesday or Thursday this week about this matter and I then received a text last night off my ex saying she knows I contacted CSA and that she is going to make my daughter homeless........

Hi there

I'm no expert but I do know that the CSA link a parents entitlement to child benefit with the payment of child maintenance, if your ex is still claiming CB then this may be where the problem lies.

I wouldn't have thought that your ex is entitled to either CB or CM, but If your daughter had been attending full time education through the pregnancy then she may have been entitled to it at that stage. Once your daughter is claiming benefits in her own right I would have thought her mothers entitlement ends.

The fact that your ex is using her daughter and new baby in this way is awful.

may be another way of looking at this - if you ex is going to make your daughter homeless, then I would contact the council - with young baby, she is going to be very high up in the priority for a council house, so may remove your ex from the situation completely.

I have provided some links for you which explain eligibility criteria for child maintenance and for Child Benefit. The two payments do usually run in line with each other, so if Child Benefit is still being paid, maintenance payments would be expected as well.

You will see the information in the second link does state that Child Benefit is not payable if the child is receiving Income Support in their own right.

how may you prove inegibility for example if the child has moved abroad?
