[Solved] CSA to CMS payments

Hi new to site and plenty of interesting topics but don't see any that covers the change from CSA to CMS scheme.

I've had notification that my existing CSA case is being closed and will move to CMS scheme unless a voluntary arrangement is entered into which given previous history is unlikely.

I've had a check at the online calculator & looks like my payments will increase by approx £200/month...

The difference appears to be as its based on your gross pay & doesn't take account of the amount of tax you have to pay (I'm company car driver) so have huge chunk of wages going to tax man. Don't see where this is taken into considertaion in the calculations?

Has anyone else moved from csa to cms and what was implication to your monthly payments?

Any guidance would be greatly appreciated as this seems an excessive jumping monthly payments.

Hi there

That does seem like an unreasonable increase! You are correct in that calculations under the new CMS scheme are made on gross income, but I was under the impression that the percentage per child has been reduced to account for this.... I'm no expert though so hopefully someone will be along that has direct experience of this.

In the meantime I'll move your post over to the Child Maintenance section where it stands a better chance of getting seen and responded to.

Thank you for your post. Mojo is correct in stating that the Child Maintenance Service work out child maintenance differently to that of the Child Suppport Agency (CSA). You can find more detailed information on how the Child Maintenance Service calculate child maintenance on Gov.uk at https://www.gov.uk/government/publications/how-we-work-out-child-maintenance.

With you being informed that your CSA liability is coming to an close, you may wish to contact Child Maintenance Options to discuss how you can set up child maintenance going forward. You can find more information about this organisation, including their contact details on Gov.uk at http://www.cmoptions.org.

Hi,

Just an update on this i've calculated a potential 45% increase on what I currently pay which seems way over the top & given that i already pay a considerable amount will mean I will have to make cuts elsewhere to cover the additional cost.

I spoke to CMS today who after a lot of waffle admitted it did seem extreme but until the case had been raised they couldn't provide a detailed response and suggested the only way round it was to apply for a variation on the grounds that the company car & the tax i incur is a necessity for my job but wouldn't comment if it would be successful or not.... so no further forward.

I'm going to suggest a voluntary arrangement but given history of previous experiences I doubt this will wash so wait & see...

Is there any way you can use your own car and claim mileage instead? That would reduce your tax burden, though I'd get proper financial advice before doing this as it's not an area I know much about.
