I am having a right nightmare . A year ago my daughter left home cause she fell out with her boyfriend. Moved in with someone who is looking after her mothers other kids as they been taken of off her. This woman who had nothing to do with me the. Claimed all the benifits and a claim through Csa.
I have been paying this even though I never kicked my daughter out and have always said she should come home and not live with a strangers family.
Anyway she was doing a course at college classes as non higher so I paid. This year she should be in a higher course now and this woman has fobbed of child benifits with a story of the course being a modular course and includes o level.
I been to this college and all higher courses are modular but it's sill got a course name as either a higher national certificate or higher national degree. But they have swallowed her rubbishy and they still Pay her benifits and Csa still want money of me.
How do I fight this. She eighteen left home I have no rights. She made no contact with me since leaving even though we live in the same town.
Can anyone tell me how to find out or make the child Benifit poeple properly check as they try to fraudulent claim money of me and the govermant
Thanks
This doesn't sound like a degree course, so it's possible that it's not classed as advanced education, in which case child benefit would still be payable. If there are 'O'Levels still included, is it actually an A level equivalent course?
Hello Johnnyfox
If you have a family-based arrangement in place you may wish to speak to the other parent in regards to when your payments would end. Although family-based arrangements are not legally enforceable, parents can decide the terms of their agreement to suit their current circumstances, as there are no strict rules or formulas to follow.
The Child Maintenance Options website has a useful tools and guides section that you and the other parent may find helpful when trying to negotiate your family-based arrangement. This can be found at http://www.cmoptions.org.
If you have a case with the Government’s statutory scheme you may wish to contact them directly to discuss any concerns you may have regarding your payments. You will find their details on any letters they have sent you or on Gov.uk at https://www.gov.uk/child-maintenance.
If you have a Consent Order/Minute of Agreement in place you may wish to see what is stipulated within your agreement, regarding how your payments are calculated. Alternatively, you may want to seek legal advice.
For more information on all the different ways to set up child maintenance and for a more personalised service, you can visit the Child Maintenance Options website.
The DWP have a sorting out separation web-app that you may find useful. It offers help and support to separating and separated families. The link is: www.dad.info/divorce-and-separation/sorting-out-separation.
