[Solved] CSA Procedures

Hi, my ex has recently got the CSA involved for maintenance payments and am having some real issues with the way they are handling my case.

I lost my job in Feb 2014 and spent most of the year on benefits in the form of housing benefit and job seekers allowance. I also had a part time job for a few months.

When calculating how much i need to pay, the CSA are refusing to take this year into account and want to go back two years to when i was earning £25k PA.

Has anybody else had this problem and is this legal? I could have been a millionaire two years ago!

I am paying maintenance now based on the fact that i am only earning £150 per week and have used the CSA calculator to do this but they won't accept it.

I have appealed but they have not done anything about it

Hi there

If you have appealed and haven't got anywhere then it might be a good idea to go and see your MP.

As far as I'm aware they should be taking your earnings in the previous 12 months, but I'm not an expert on CHild Maintenance.

When you say you've appealed, have they given you a decision on the appeal? Did you go through the full appeals process?

I'd certainly look at seeing your MP as suggested above.

Hi, thanks for your reply. I did follow the complaints procedure and even though i did appeal their initial decision they did not accept it.

Since my original message i sent them a letter and proof of earnings from last year along with a letter instructing them that i would take it to tribunal. Today they have called to tell me that now all they want to do is use my current earning!!!! I just need an accountant to do my tax return and send a letter confirming my income.

Hopefully this will now be resolved and if anyone reading this is going through issues with the CSA it is important not give in to them and push for the correct resolution.
