Hello everyone, I have a question about CSA payments and need some advice and support etc. I have 4 kids 2 with 2 different women who I currently pay a set figure too each month. My last ex has her new partner moved in, does this change the payment?

Hi DVP

Thank you for your post. Under the child maintenance rules, who the parent with care lives with (or their partner or spouse's income) is not taken into account when calculating the paying parent's child maintenance.

However, if you and your last ex-partner have agreed child maintenance privately via what is known as a family-based arrangement, both of you have the freedom to decide the terms of your agreement between yourselves. This is because a family-based arrangement is not legally-binding and there is no court or statutory involvement in your arrangement.

Where your child maintenance is being managed by either the Child Support Agency (CSA) or the Child Maintenance Service, you may wish to contact the relevant organisation to discuss your query in further detail.

If you and your last ex-partner have set up child maintenance via the courts, you will need to review the terms and conditions of your order that were agreed to clarify if your maintenance will be affected by the other parent's new partner moving into the same property. To do this, you will need to seek legal advice.

For more information about the ways that child maintenance can be arranged, you may wish to contact Child Maintenance Options directly. You can find their contact details on their website at http://www.cmoptions.org.

The DWP have a sorting out separation web-app that you may find useful. It offers help and support to separating and separated families. The link is: www.dad.info/divorce-and-separation/sorting-out-separation.

Regards

William
