Hi There,

This will all come down to whether child benifit is still being paid, childmaintenance and child benifit go hand in hand, if she is within the boundaries of child benifit then yes you still pay, look into the child benifit side and then you could call CSA/CMS and ask them based on what you find.

Hello JA

Under child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-Level or equivalent), or for as long as Child Benefit is being paid. When a child leaves full-time education in the summer, Child Benefit generally continues until the first week of September. You can find more information on when child maintenance stops on Gov.uk at https://www.gov.uk/when-child-maintenance-payments-stop.
If you and the other parent agreed child maintenance privately via a family-based arrangement, there are no strict rules to stick to. This is because a family-based arrangement isn’t legally-binding and there is no involvement from the courts or the statutory child maintenance services in your agreement.

Where child maintenance has been set up with either the Child Support Agency (CSA) or the Child Maintenance Service, you will need to contact the respective organisation that is managing your child maintenance directly to discuss your query. You can find the relevant contact details on any letters that you may have received or you can visit Gov.uk at https://www.gov.uk/child-maintenance/contact.

If you have set up child maintenance via the courts, in the form of a Consent Order or Minute of Agreement, you will need to seek legal advice to clarify what is written into the terms of your agreement on when your child maintenance will cease.

To find out more about child maintenance, you may wish to visit the Child Maintenance Options website at http://www.cmoptions.org. You can also find their contact details listed on this site.

You may be interested to know that the Department for Work and Pensions (DWP) have a new web application, 'Sorting out Separation'. It aims to make it much easier for separated parents to find the support they need, when and where they need it, and encourages them to collaborate on a range of issues.
