[Solved] csa payment that my X is claiming hasnt been payed

hi am new to this site and would like some advice,

my xpartner has made a claim to csa that i have never payed maintenance for the last 4 years and now i have 2 liability orders, the first from nov 2012 to dec 2015 for £1300 and the second from dec2015 to nov 2016 for £1500, i can prove that ive made a total payment of £2200 for the 2012 to 2015 period but unfortunatly started paying it by cash after that which i should has know better, my question is what happens about the overpayment that i have made (£900) for 2012/2015 does that get taken off the 2015/2016 liability order, can i claim this overpayment back some how or does she just get away with it?, will she be liable for making a false fraudulent claim and be taken to court like i was? or is the csa department completely one sided on theses matter?

Hi there

Your best bet is to appeal the decision I think, this isn't my area of knowledge but if you can prove you've made payments, I would put that in writing to them, along with any documented proof (copies). If they accept it then they're likely to offset any overpayment against the following years "arrears"... if you've paid cash then you aren't going to be able to prove you made those payments unfortunately and they may not accept that you did.

I doubt very much that there'll be any come back for her unfortunately. Hopefully other members with more knowledge should be along shortly.

I agree with mojo, any cash payments aren't going to be accepted, so I'm afraid they won't count, but hopefully the other payments will all be assessed against the total you should have paid.
