please help, my daughter is 19 in october, she left college on may 24th to take 1 year out to ponder her future, she might go to university in august 2014,if she doesnt find employment in the meantime, she currently works part time in a bar doing approx 10 hours per week. can you tell me when i will stop my child supports payments please. many thanks.
Are you currently paying via the CSA or is it a private agreement.
From what you have said, she is no longer in full time education (or any education for that matter) so I would say that your payments would stop in September this year. If you are paying via the CSA, I'd give them a call and discuss it with them.
Hi Karlfedup
Thank you for your post. I am William the Child Maintenance Options consultant and I will give you some information. Child Benefit and child maintenance are linked to each other. If your daughter's mother is receiving Child Benefit and with your daughter leaving full-time education, the Child Benefit would stop in September and your payments may stop.
Under child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid.
If you currently pay child maintenance through a family based arrangement, you may wish to discuss with your daughter's mother about your payments. As there are no strict rules or formulas when calculating your payments and family-based arrangements are not legally binding, however, they are quick, easy and flexible to change if you or your daughter's mother circumstances do.
If you currently have an arrangement with the Child Support Agency (CSA) you may wish to speak to them when you payments will finish. Their contact details can be found on any letter they have sent you, or this website https://www2.dwp.gov.uk/csa/v2/en/setup/apply-by-telephone.asp provides their contact details.
In the event you currently have a Consent Order in place for child maintenance, you may wish to consult with the solicitor who started the original proceedings. Alternatively, by using the following link on https://www.gov.uk/find-a-legal-adviser this can help you find legal help in your area.
There is also a Sorting out separation web-app on this website at http://www.dad.info/divorce-and-separation/sorting-out-separation that you may find useful as it offers help and support to separating families.
You can also find useful tools and guides on our website at www.cmoptions.org. Or if you prefer to have a confidential chat with one of our agents you can call 0800 988 0988, we are open Monday to Friday 8am to 8pm and Saturday 9am to 4pm.
I hope this helps.
William
